JOB TITLE: CITY ATTORNEY
SALARY: NEGOTIABLE
BASIC FUNCTION:
The City Attorney is selected by the City Manager and this appointment must be confirmed by the City Council. The City Attorney is to direct all of the Civil and Criminal legal work of the City and plan and develop an adequate program in relation to municipal activities. The City Attorney is the legal advisor of the Mayor, City Manager, City Council, and Department Heads. Duties require the exercise of extensive independent judgment as the ultimate legal authority for the City. Supervision is performed in accordance with general policies of the City Manager and City Council and the accepted standards and practices of the legal profession. Work is directly performed under the general supervision of the City Manager.
ESSENTIAL FUNCTIONS:
Performs the duties of City Attorney and City Prosecutor as specified in the Utah Code
Renders oral and written opinions to the Mayor, City Manager, City Council, Department Heads, and other City Officials
Attends City Council and other meetings and conferences for the purpose of learning the policies underlying official action and gives advice on legal questions involved, including advice as to alternative legal and administrative approaches to the solution of major City problems, other meetings may include but are not limited to Planning Commission Meetings, Work Meeting, Department Head Meetings, Pre-City Council Meetings, Post City Council Meetings, etc.
Represents and supervises the work of the professional staff of the City Attorney's Office including the City Prosecutor, paralegal, and legal secretary
Conducts or supervises the representation of the City in all civil and criminal matters
Advise the City on all laws, policy, regulations, and procedures which may affect or impact the City
Assist the City in all HR matters
Advise and represent the Grantsville City Redevelopment Agency
Advise and represent the Grantsville City Municipal Building Authority
Fulfills Government Records Access and Management Act (GRAMA) requests as specified in the Utah Code
Reviews information to keep informed of proposed state and federal legislation affecting the City
Prepares or approves proposed ordinances, resolutions, and contracts for final consideration by the City Council, also including but not limited to Notices to Proceed, Notice of Award, Memorandum of Understanding, Requests for Proposals, Interlocal Agreements, Purchase Agreements
Demonstrates continuous effort to improve operations, decrease turnaround times, streamline work processes, and work cooperatively and jointly to provide quality seamless customer service
Provides counsel for the Grantsville City Police Department and the Grantsville City Volunteer Fire Department
Engages in Police training and gives advice on legal questions involved
Represents the City by engaging the public and/or providing public speaking services
Continuously meets with citizens to answer questions, solve problems, and provide quality seamless customer service.
REQUIRED KNOWLEDGE AND ABILITIES:
Knowledge of:
City Code and state law with particular reference to municipal legal provisions and municipal law.
The judicial procedure, rules of civil and criminal procedure, and rules of evidence. Principles and practices of personnel management and supervision.
Ability to:
Work cooperatively with the Mayor, City Manager, City Council, other employees, customers, clients, and the public.
Organize, interpret and apply legal principles to complex legal problems.
Considerable knowledge of municipal and general law, including but not limited to elections law; state and federal constitutional law and relationships; state law and procedures regarding municipal administration; parliamentary procedure; revenue and taxation, bonding, public debt and fiscal law; Fair Labor Standards Act and other applicable personnel, employment and labor law; workman’s compensation and unemployment insurance; natural resources law, with an emphasis on water and public lands law; the powers and duties of cities and municipal officials; local government organization; state and local legislation types and procedure; eminent domain, impact fees and exactions; public tort liability law and governmental immunity; annexation and zoning law; Fair Housing Act and related statutory and case law; environmental law and liability; the law of the safe workplace (including OSHA, Health Department, DEQ, and EPA regulations); administrative law; community and economic development; public accessibility to governmental documents and information (e.g., GRAMA, FOIA, and the Privacy Act); intergovernmental relations, compacts, grants, and revenue sharing; lien law; government contract law and procurement law; “Sunshine” and “open meetings” laws (e.g., OPMA); government ethics and disclosure laws; land use planning, development, regulation, and redevelopment; zoning; nuisance abatement; anti-discrimination laws, including ADA (Americans with Disabilities Act); franchise and telecommunications law; contract law; business and corporate law; and criminal law.
Skill in legal research and analysis, risk analysis, trial preparation, drafting of legal documents and effective oral and written communications. Demonstrated ability, in both oral and written communications, to be concise, yet complete; logical, unbiased, and unemotional; and informative, interesting, and persuasive.
Ability to think; anticipate and evaluate issues; read for detail and comprehension for long periods of time; plan, set goals, and self-monitor; work alone, with little supervision, and under stress; work cooperatively with elected officials, City staff, and City employees; communicate effectively; facilitate discussion and problem-solving, and be a self-starter. Ability to “see the issues” and to logically and effectively analyze statutes, ordinances, case law, and factual date; be detail-oriented.
QUALIFICATIONS:
Must have passed the Utah State Bar exam and must hold and maintain a current license to practice law in the State of Utah.
ACCEPTABLE EXPERIENCE AND TRAINING:
Five years of experience as a practicing attorney performing high-level legal and trial work and graduation from an accredited school of law. Other combinations of experience and education that meet the minimum requirements may be substituted.
WORK ENVIRONMENT:
Tasks require a variety of administrative and physical activities, which include office and field-related functions such as writing, organizing, managing, running, walking, standing, stopping, sitting, pushing, pulling, and reaching. Essential functions require talking, hearing, seeing, and common eye, hand, and finger dexterity.
