The PUC is seeking The PUC is seeking an Attorney who has a desire to work in the utility regulatory industry, with a strong initiative, who would like to put their expertise and interest to work performing highly complex to advanced professional legal work for the Market Analysis Division. Primary duties involve the practice of administrative law including, but not limited to, analyzing complex issues related to energy markets and developing legal opinions, participating in and leading contested case proceedings, projects, rulemakings, legislative analysis, and related policy-development activities. Work involves extensive contact with market economists and engineers, industry representatives, and other professional staff. Work under limited to minimal supervision with considerable latitude for the use of initiative and independent judgment.
Provide legal expertise and analysis relating to competitive electric markets, regulated electric utilities, and infrastructure planning as assigned. May also work on issues relating to the agency’s oversight of the telecommunications and water industries.
Monitor and provide legal expertise relating to activities conducted by the Electric Reliability Council of Texas (ERCOT) and ERCOT stakeholder committees, other state agencies, Midwest ISO (MISO), Southwest Power Pool (SPP), and the Federal Energy Regulatory Commission (FERC).
Communicate with management on policy and market issues, preparing written briefing materials summarizing and evaluating applicable law and applying the law to relevant facts.
Participate in policy development and rulemaking activities in coordination with other divisions, including conducting legal research and preparing recommendations and documents for Commission action.
Provide information and represent the agency when needed regarding Commission policies and procedures to industry stakeholders, customers, personnel of the legislature, other government agencies, and the public.
Work with the Legal Division and other Commission Staff to manage the oversight of rules and protocols relating to the electric market.
Participate in the investigation of issues relevant to the electric industry and the preparation of reports on topics including electric reliability and operations, market efficiency, market power, service availability, and other relevant matters.
Track contested cases and stay informed of the issues being addressed; provide legal advice and recommendations as needed.
Review uncontested filings for consistency with Commission policies, rules, and orders.
Work with subject matter experts to prepare written or oral expert testimony for filing in contested proceedings and defend testimony under cross-examination. Work closely with professional staff in the pre-hearing through post-hearing stages of contested cases.
May be required to travel out of state for trainings and meetings.
Demonstrate a spirit of teamwork, offering positive and constructive ideas, encouragement, and support to other members of the staff and team, while upholding the PUC’s mission and core values.
Adhere to all PUC personnel policies and division procedures and perform other work as assigned.
REQUIRED MINIMUM QUALIFICATIONS:
Graduation from an accredited law school with LLB or JD degree.
Licensed and eligible to practice law in Texas.
Attorney III: Minimum of three (3) years legal work experience, preferably in utility regulation or administrative law.
Attorney IV: Minimum of four (4) years legal work experience, preferably in utility regulation or administrative law.
Directly relevant regulatory work experience may be substituted for the legal work experience requirement.
Administrative law or litigation experience.
Legal experience with the electric utility industries.
Experience interacting with ERCOT.
