Boutique law firm seeking Associate Attorney with 3 years of Customs and Trade experience. The candidate will assist Customs and Trade legal and regulatory matters for domestic and international clients. Expect to work primarily with clients in the food, dietary supplement, drug, cosmetic, and medical device industries. Customs and Trade matters may involve clients in all industries.
The primary focuses in this position include conducting legal research, analyzing data, drafting evidence-based opinions, and providing oral and written advocacy before government administrative agencies primarily Customs and Border Protection (CBP). Other agencies such as Department of Commerce, United States Trade Representative (USTR), and the United States International Trade Commission (ITC). Attorneys at Benjamin L. England & Associates, LLC have opportunities to perform litigation before the Court of International Trade, the Court of Appeals for the Federal Circuit, and other federal courts.
Assist with Customs & Trade related legal matters including:
Advise clients and assist with CBP Liquidated Damages Claims Petitions, Offers in Compromise, CBP civil seizure actions, CBP holds, detentions and investigations, CBP requests (CF-28, CF-29), FTA applicability and documentation, and similar CBP and trade-related matters, including assistance with forced labor issues as needed;
Coordinate, compile, modify, and draft written responses to federal and state regulatory agencies;
Perform legal and regulatory reviews of client files and product materials, draft evidence-based opinions influencing successful importation or exportation of products;
Communicate effectively, professionally, knowledgeably, and in a timely manner both orally and in writing to managers, colleagues, clients, and government agencies maintaining appropriate Firm image;
Draft reports and procedure manuals for clients that conform to the prescribed style and format for the purposes of implementing and improving business processes in compliance with regulatory requirements;
Understand government agencies’ regulatory requirements, develop strategies, identify and obtain data and evidence required to support strategies, draft advice and opinions for clients and/or agency for the purposes of bringing identified product(s) into compliance;
Read, analyze, and interpret laws, regulations, and policy under Customs, FDA, FAA, USDA, DOT, and other federal and local regulatory agencies, articles in scientific, regulatory, and technical journals, and legal documents;
Support other attorneys in the legal representation of clients before federal and state agencies, courts, and third parties;
Support for the Custom and Trade Team:
Monitor the Customs Bulletin and Decisions online and report to Customs and Trade Team via email correspondence;
Manage and monitor protest deadlines, and other report deadlines on a weekly basis and report to the Customs and Trade team;
Monitor and Review the Federal Register on a weekly basis to provide information to the Customs and Trade team;
Monitor the Court of International Trade and the Court of Appeals for the Federal Circuit slip opinions to provide awareness to the Customs and Trade team and for possible marketing topic creation;
Maintain or work with the docket clerk to maintain litigation/docket calendar
Firm Marketing; Support marketing, educational content, and business development efforts
Maintains relevant credentials required for the position. Participates in CLE and maintains leading-edge knowledge and skills in their area of expertise, as required.
Strong interpersonal skills with the ability to influence and achieve successful results through effective interactions.
Excellent research and writing skills, extensive internet skills for legal research, and advanced experience using MS Office (Word, Excel, Outlook, and PowerPoint) and Adobe.
Excellent organizational, document, and docket management skills.
Excellent communication and mechanical writing skills free of typographical, grammatical, and punctuation errors.
Flexible, eager to learn, and able to manage dynamic environments and rapid change.
Maintains an appropriate firm image in all client communications.
Administrative and marketing duties such as drafting blogs, press releases and presentations, attending conventions, and speaking events.
EDUCATION AND/OR EXPERIENCE REQUIREMENTS
J.D. degree from an ABA-accredited law school. Minimum 3 years relevant legal experience with demonstrated skills and expertise
Licensed to practice law in any state and/or the District of Columbia.
Knowledge of Microsoft Office software and extensive internet and computer skills for legal research are required.
Prior work experience with FDA and/or other government agencies preferred, but not required.
Spanish, Korean or other foreign languages capabilities preferred, but not required.
Additional Salary Information: Salary will be based on the experience level of the candidate.
